ARTICLE 1. PURPOSE
These General Conditions of Sale (GCS) govern the contractual relations between the company A2 UNITY, hereinafter referred to as "the Seller", and any natural or legal person, hereinafter referred to as "the Customer", wishing to make a purchase via the website www.lumiconcept.com, hereinafter referred to as “the Site”.
ARTICLE 2. ACCEPTANCE OF CONDITIONS
Any order placed on the Site implies the unreserved acceptance of these General Terms and Conditions by the Customer. The applicable General Terms and Conditions are those in force on the date of the order.
ARTICLE 3. PRODUCTS
The products offered for sale are those appearing on the Site on the day of consultation by the Customer. Each product is accompanied by a description established by the Seller. The photographs of the products are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly with regard to colors.
ARTICLE 4. PRICE
Prices are indicated in euros, all taxes included (TTC), excluding delivery costs. The Seller reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in effect at the time of validation of the order. Delivery costs are indicated before validation of the order.
ARTICLE 5. ORDER
The Customer places an order on the Site by following the process provided for this purpose. Any order constitutes acceptance of the prices and descriptions of the products available for sale. The Seller will acknowledge receipt of the order upon validation by sending a confirmation email.
ARTICLE 6. PAYMENT
Payment is made online by credit card via a secure system or by any other means of payment offered on the Site. The total amount of the order must be paid when it is validated. The Seller does not have access to any data relating to the Customer's means of payment.
ARTICLE 7. DELIVERY
The products are delivered to the delivery address indicated when ordering. Delivery times are indicated on the Site and may vary depending on the availability of the products and the place of delivery. In the event of a delay in delivery, the Customer will be informed by the Seller. If delivery is not made within the expected time, the Customer may cancel his order and obtain a full refund.
To offer you high quality products at competitive prices, the products are prepared and shipped directly by our manufacturing partners and sometimes also manufactured on demand. They become our property once your order is placed and we are responsible for the delivery of the goods to your delivery address.This mode of operation results in additional delays linked to manufacturing and logistics.
ARTICLE 8. RIGHT OF WITHDRAWAL
The Customer has a period of 14 days from receipt of the products to exercise his right of withdrawal, without having to justify reasons or pay penalties, with the exception of return costs. The products must be returned in their original condition and complete (packaging, accessories, instructions, etc.) to be reimbursed.
ARTICLE 9. WARRANTIES
The products sold benefit from the legal guarantee of conformity and the guarantee against hidden defects, in accordance with the legal provisions. In the event of non-conformity of a product sold, it may be returned to the Seller who will take it back, exchange it or refund it.
ARTICLE 10. LIABILITY
The Seller shall not be held liable for damages resulting from improper use of the purchased product. The Seller shall not be held liable for any inconvenience or damages inherent in the use of the Internet, including a breakdown in service, external intrusion or the presence of computer viruses.
ARTICLE 11. PROTECTION OF PERSONAL DATA
The personal data collected on the Site are necessary for order management and the commercial relationship. They may be transmitted to the Seller's partners responsible for the execution, processing, management and payment of orders. In accordance with the "Informatique et Libertés" law, the Customer has the right to access, rectify and oppose personal data concerning him/her, by contacting the Seller's customer service at the email address help@lumiconcept.com.
ARTICLE 12. INTELLECTUAL PROPERTY
All elements of the Site are and remain the intellectual and exclusive property of the Seller. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the Site whether software, visual or audio.
ARTICLE 13. DISPUTE RESOLUTION
These General Terms and Conditions are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing this, the French courts will have sole jurisdiction to settle the dispute.
ARTICLE 14. MODIFICATION OF THE GTC
The Seller reserves the right to modify these General Terms and Conditions at any time. The new general terms and conditions of sale will be applicable to all orders placed after they are posted online.
